Tradie Web Solutions Terms & Conditions

  1. Introduction

These terms and conditions (“Agreement”) govern the use of the web development services provided by Tradie Web Solutions (“we,” “us,” or “our”) to the client (“you” or “client”). By engaging our services, you agree to be bound by this Agreement.

  1. Services

We will provide web development services as outlined in the project proposal or agreement signed by both parties. Any changes or additions to the scope of work must be agreed upon in writing.

We will make reasonable efforts to meet project deadlines but do not guarantee specific delivery dates unless specified in writing.

  1. Payment

Client agrees to pay Tradie Web Solutions the fees outlined in the project proposal or agreement. Payment terms and methods will also be specified in the project proposal or agreement. Unless otherwise stated, payment terms are 50% payment required at commencement and 50% payment required a completion prior to project handover.

We reserve the right to withhold website launch until full payment has been received.

  1. Ownership and Rights

Upon full payment, you will own the final website design and code. However, we retain the right to reuse any non-proprietary code and design elements for other projects.

We may use the project as part of our portfolio and marketing materials unless you request otherwise in writing.

  1. Client Responsibilities

You agree to provide all necessary materials, information, and approvals required for the project in a timely manner.

You are responsible for ensuring that any content provided does not infringe on third-party rights and complies with all applicable Australian laws and regulations.

  1. Confidentiality

Both parties agree to keep confidential all non-public information and materials exchanged during the project, in accordance with Australian privacy laws.

  1. Termination

Either party may terminate the project by providing written notice. In the event of termination, you will be responsible for payment for all work completed up to that point, as required by Australian contract law.

8. Liability

Our liability is limited to the fees paid for our services. We are not liable for any indirect, consequential, or special damages, as allowed under Australian consumer law.

  1. Dispute Resolution

Any disputes arising from this Agreement will be resolved through arbitration or mediation in accordance with Australian dispute resolution standards.

  1. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Commonwealth of Australia and the applicable state or territory.

  1. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.

  1. Amendments

We may modify these terms and conditions at any time by providing written notice to you. Your continued use of our services after such notice constitutes acceptance of the modified terms.

By engaging our services, you acknowledge that you have read, understood, and agreed to these terms and conditions in compliance with Australian law.
